There # 39; s confusion surrounding a petition booth at the Sioux Empire Fairgrounds this week.It asks for trademarks in assistance of capping pay day loan interest rates at 18-percent. The proposed change would also let customers optpull out and get loans at a greater rate than 18. However, this petition has not been approved by the appropriate channels to acquire trademarks.

We talked with State authorities and people with the petitions for some answers.

From a distance, this booth doesn # 39; t draw much attention at the fair. Just a few short individuals sitting at a table covered in papers. When you walk up you can see some papers state Cap Pay Day Loans at 18 percent %, and there are petitions to sign.

This constitutional change was proposed by South Dakotans for Fair Lending. However, that petition request is still awaiting approval.

This specific subject is, I believe, over at the AttorneyAttorney general of the united states # 39; s workplace awaiting a title and description to be placed on the petition kind, Secretary of State Shantel Krebs stated.

After a petition is signed off by the AttorneyChief law officer, it moves on to the Secretary of State # 39; s workplace before it can be circulated for trademarks.

Krebs says the signatures being collected now will certainly not be considered legitimate.

At this point, right now, this certain measure or proposed group does not have the certification to be recording legitimate signatures. At this point, the signatures then would be throwntossed out and not be counted, Krebs said.

There are indications at the booth specifying this is an advisory petition, and asks individuals to sign the main petition later on this month. However, when we asked Krebs about this, she says there is no such thing as an advisory petition on state statute.

Krebs states it # 39; s vital petitioners go through the proper channels, so people are totally informed on what they are signing.

If you # 39; re signing a petition, I would make sure to see that there is a complete title and description from the AttorneyChief law officer # 39; s workplace at the top of the title and type of the petition, Krebs said.

So what is the point of collecting these signatures? The individuals behind the booth at the fair informed us they might not discuss exactly what they were doing there and gave us call info for a woman called Lisa Furlong. According to the Secretary of State # 39; s site, she is the Chair and Treasurer for South Dakotans for Fair Loaning.

She sent KELOLAND News a statement, saying the advisory petitions are designed to evaluate support for the measure and raise awareness.
